In total, 130 testimonies reached this retired English teacher, herself assessed by the doctor in 2009, diagnosed as paranoid after a ten-minute interview and placed on compulsory leave. “There is nothing medical in the interviews that Brunner conducts. He refuses to examine the documents, even medical ones, provided by the patients. There is absolutely nothing ethical in his methods ,” denounces Marie-Charlotte Elsaesser. ” His opinion is made before the assessment, the patients are condemned in advance. He imposes pathologies, such as alcoholism, on the patients without any proof, preventing any compensation, or prohibiting visitation rights, in cases concerning child custody, during separations.” Up to 700 appraisals per year A feeling of contempt also felt by psychiatrist Georges Federmann. In 2022, along with four other colleagues, he filed a complaint against Henri Brunner with the Medical Council. “In his conclusions, he takes absolutely no account of the opinions or follow-up of the attending physician ,” he denounces. “Everything is swept aside in 10-15 minutes, including the work of other doctors, sometimes carried out for years. He places himself in the position of the expert in front of vulnerable people. With his aura as a former head of department, he was not denounced, and he is made the reference for psychiatric expertise. ” As proof, Henri Brunner has become, over the course of his career, one of those essential experts, regularly called upon by the courts, administrations, and insurance companies. He has conducted up to 700 expert appraisals per year and has a total of 6,800 reports written in the context of criminal proceedings between 1977 and 2024. A figure that puzzles Georges Federmann. “How are these doctors recruited? Why do the institutions that summon them continue to call on the same ones? I’m appalled by the number of expert assessments he’s conducted! Our reports are crucial moments for our patients; they can be decisive for them for years to come… So when I know that Brunner performs hundreds of them a year… We need to review the expertise, work collaboratively, especially with the treating physician.” And Guillaume Krempp, a journalist for Rue89 Strasbourg who brought this affair to the media, added: “Expertise is poorly paid. We are in a context of lack of resources, in the justice system, in medicine. So we create “serial experts,” who are called upon all the time, also because they provide a service to the institutions that commission them. Brunner serves their interests, his reports support their interests. Claire Lauffenburger Psychiatrist who denounced Dr. Brunner’s actions It took six more years, and the class action lawsuit, which the medical association ultimately joined—a rare thing—for the expulsion to be pronounced on January 10th. “Late,” says Claire Lauffenburger. This psychiatrist was one of the first people to have denounced her colleague’s actions more than 30 years ago. “One of my patients was examined by Henri Brunner following an attempted murder of which she was the victim. She came back devastated, it took more than six months for her to recover from the examination. Ethically, it’s impossible to accept, that’s why I went to the front.” She then denounced this behavior to the association, which said it could not act without a complaint. A suspensive appeal in progress “There has been a general lack of action. Many people are aware, but for convenience, they keep quiet. For us, too, it was difficult to go as far as filing a complaint.” Guy Birry, the new president of the Bas-Rhin Medical Association, admits that “it took time” to process the case and refutes any suspicion that Dr. Brunner was being protected. “There is no self-interest among doctors, we are not at all trying to protect doctors from patients, we are trying to be fair, to also see if what the patient says is true.” He also explains the interminable delay in responding by the desire to cross-check complaints and respect the process to prove that the code of ethics has been violated. “You have to examine each complaint, ask the doctor for explanations, then listen to the patient to try to propose a conciliation.” When contacted, the Colmar Court of Appeal—one of Dr. Brunner’s main representatives—and the Regional Health Agency, responsible for validating the list of approved physicians, declined to comment on the matter. Neither did Dr. Brunner’s lawyer. The latter appealed the decision to strike off.
